Tournament Rules

The PlayWorks-DISH Networks Games Channel 96 (“Hopper Arcade”) Tournament (the “Tournament”) is intended for participation only in the 50 United States and the District of Columbia and shall be construed according to, and governed exclusively by, United States law. For the sake of clarity, subscribers in Alaska, Hawaii and Puerto Rico are not eligible for participation in the Tournament. Do not participate in the Tournament unless you meet the eligibility requirements set forth below and are a legal resident physically located in the United States at the time of entry. Minors must get permission from their parents or legal guardians to enter. The following Official Rules apply to all Tournaments. 1. Description of the Tournaments

Hopper Arcade offers various games to persons who subscribe to Hopper Arcade on the EchoStar Dish Network. Hopper Arcade will periodically select a game(s) from its inventory and will notify its subscribers onscreen. Each Tournament will provide subscribers (“Players”) with the opportunity to compete for prizes. Each Tournament will be conducted over a specified period of time, which will be announced at the start of the Tournament.

2. Eligibility

To participate in a Tournament, you must be a legal resident of the United States who (1) subscribes to Dish Network and (2) subscribes to the Hopper Arcade service and whose account is in good standing. Only one prize per household per tournament as applicable. Employees of EchoStar, PlayWorks Digital LTD., PlayWorks Digital LTD Inc., Hopper Arcade and their affiliates and subsidiaries, promotion and advertising agencies (the “Promotion Entries”), and members of their immediate families (regardless of whether they reside in the same household) are not eligible to participate. Tournaments are void in Maryland, North Dakota and Vermont and where prohibited by law.

3. How to Play

You must first subscribe to the Hopper Arcade service on Dish Network at a cost of $6.00 per month by following onscreen instructions or by calling Dish Networks directly. From time to time the Sponsor may open Tournaments to non-subscribers in accordance with these Rules. In such cases, a notice will be placed onscreen. The Tournament game will be assigned with a Tournament icon. When submitting your score, for that specific Tournament designated game then you will be asked to enter a nickname unique to Hopper Arcade. If you enter a word that we deem a “banned word” that nickname will not be accepted and you will be asked to enter a new nickname. Each Tournament will have its own prizes and scoring system (most points, fastest time, etc.). Scoring and prizes for each Tournament will be described at You will compete against the game to get your best score possible and that score will be measured against the scores of other players for the best overall Tournament score. At the end of the Tournament period, the scores will be tallied, winners will be determined, and prize winners will be announced. The score on the leaderboard at the end of the Tournament will be final. Hopper Arcade database clock will be the official time keeper for all Tournament purposes. If you are deemed a prizewinner, you will be notified by Hopper Arcade. Decisions of the Sponsor are final and binding in all matters related to Tournament play and winners.

4. Winner Notification

The winner(s) of each Tournament will be notified within forty-five (45) days after the completion of each Tournament using the information you provided to Dish Networks for billing. You are responsible for updating your contact data. Sponsor is not responsible if any potential winner notification is not received by the winner for any reason. The winners of each Tournament will be required to sign and return, an Affidavit of Eligibility and the winner of such tournament will be asked to submit a photograph and sign a Liability/Publicity Release, where legal, within twenty (20) days of mailed letter prize notification. If the winner is someone other than the account holder, the account holder must sign the affidavit. If any winner does not return the abovementioned documents within the specified time, if any prize or prize notification is returned as undeliverable or if any winner rejects his/her prize, such prize will be forfeited. The applicable prizes will be delivered to the tournament winners within forty-five (45) days of Sponsor’s receipt of the completed Affidavit of Eligibility and Liability/Publicity Release.

If any winner is considered a minor in his/her jurisdiction of residence, such prize will be delivered to such minor’s parent/legal guardian and awarded in the name of parent/legal guardian and such minor’s picture will not be used for publicity or marketing purposes.

5. Prizes

Prizes are not transferable. Sponsor may substitute any prize for one of equal or greater value at its sole discretion. Winners are responsible for all federal, state and local taxes. Prizes will be delivered only to a U.S. street address, not a PO Box. In the event of a tie, the winners shall split the value of the prize associated with such score as well as the next prize below it (i.e. if 1st prize is $100 and 2nd prize is $50, the two tied winners will receive $75 so the next prize given would be for third place). The prize will be sent to the account holder and given in the account holder’s name. The approximate retail values (“ARV”) of electronic prizes are subject to price fluctuations in the consumer marketplace based on, among other things, any gap in time between the date the ARV’s are estimated and the date the prizes are awarded or redeemed. If the actual purchase price of the electronics prize is less than the ARV stated herein, the prizewinner will not be entitled to a check or cash for the price difference. Acceptance of the prize constitutes permission for Sponsor and its agencies to use winner’s name and/or likeness for advertising and promotional purposes without additional compensation, unless prohibited by law. By accepting a prize, the winner agrees to hold the Promotion Entities harmless for any injury or damage caused or claimed to be caused by participation in a Tournament or his/her acceptance or use of a prize. Sponsor is not responsible for any typographical or other error in the printing of any Tournament related information, administration of a Tournament or in the announcement of a prize. WITHOUT LIMITING THE FOREGOING, ANY PRIZE OFFERED IN CONNECTION WITH ANY TOURNAMENT IS PROVIDED “AS IS”, WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-FRINGEMENT.

6. General Conduct

(a) Sponsor reserves the right, in its sole discretion, to disqualify or bar any Player or individual from future participation it finds (1) to be tampering with the registration or entry process or the operation; (2) to be acting in violation of the Official Rules; (3) to be hacking, or to be using any electronic devices to play or enter any Tournament, or to be using software which would provide a player an unjust advantage or to be acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person or Sponsor; or (4) to have provided any false or misleading information as part of the registration process.


7. Limitation of Liability

In no event will the Promotion Entities be responsible or liable for: (a) any indirect, incidental, consequential or punitive damages, injuries or losses of any kind under any theory (whether contract, tort, warranty or otherwise), including but not limited to loss of profits or Tournament prizes, arising out of any participant’s access to and use of the Service or participation in Tournament or (b) for any damages of any kind in excess of any fee paid to enter the applicable Tournament for (c) from participant’s acceptance, receipt, possession and/or use or misuse of any prize. Some jurisdictions may not allow the limitations or exclusion or liability for incidental or consequential damages or exclusion of implied warranties so some of the above limitations or exclusions may not apply to you. Check your local laws for any restrictions or limitations regarding these limitations or exclusions.

8. Privacy

(a) Entry information may be shared with Sponsor’s promotional partners to the extent participants agree at the time of entry and to the extent required for prize fulfillment purposes.

(b) Except as provided in these Official Rules or as agreed to at time of entry, any entry information collected from the Tournament will be used in accordance with Sponsor’s Privacy Policy, located on the PlayWorks site by clicking here:

9. Technical Failures

Sponsor is not responsible for electronic transmission errors of any sort that result in an omission, interruption, deletion, defect, crashes, network malfunctions, or delay in operations. Sponsor is not responsible for technical, satellite, electronic, computer, hardware or software malfunctions or limitations of any kind including, but not limited to, technical failures of any sort that occur during submission of scores. If for any reason a Tournament is not capable of running as planned, by reason of technical failures or any other causes. Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend a Tournament. Sponsor reserves the right, but not the obligation, to select winners from those who played prior to error that prompted the Sponsor’s action. Sponsors further reserve the right to disqualify any individual who tampers with the entry process.

11. Governing Law/Jurisdiction

All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of participants or Sponsor in connection with the Tournament shall be governed by and construed in accordance with the internal laws of the state of New York, without giving effect to any choice of law of conflict of law rules or provisions that would cause the application of any other state laws. Claims may not be resolved through any form of class action. Venues for all suits will be in federal or state courts located in New York County, New York.
